Abstract

During DLP, that may have a lot of defect appearing in the building due to defective workmanship or materials. The purpose of DLP is providing a period of time to the purchasers to identify the defect appeared in their building after the CPC have been issued. Nevertheless, some of the contractor is tried to ignore the defect list by purchase until the last few day before the expiry of Defect Liability Period only go for repair. This is because if the Contractor repairs immediately those defect after receive the defect list from purchaser, the defect will appear again after few months repaired for example movement of the ground may cause the wall cracking again. Three objectives are formed, which is to identify the Employer's right, Contractor's liabilities and obligations during DLP; to study DLP in SPA; to ascertain the advantages and disadvantages of DLP between Contactor, Developer and Purchaser. The research methodology of the research is case study and interview survey. The case study was conducted through the inspection to a double storey terrace houses in Selangor. Based on the case study, it was discovered that the defect commonly appear during DLP such as wall cracked, wall hollow, tile scratched or damaged, hollow tile, damaged timber floor, poor plastering and etc. Besides, interview survey identifies the objective of this study. Interview survey was conducted with experience professionals whose are Architect, Contractor and Developer. Lastly, conclusion and recommendation on this study will be summarized to determine the Contractor's obligation and liability during DLP in Malaysia construction industry.
