Abstract
Loss and/or expense claim is a method of reimbursement on loss suffered by the Contractor in the event of disruption or breach of condition of Contract. Yet, in practice, many claims in relation to loss and/or expense have been unsuccessful. Therefore, this study is to find out the extent of roles of the Consulting Quantity Surveyor, challenges faced by the Consulting Quantity Surveyor and recommendations to improve the roles of the Consulting Quantity Surveyor in assessing loss and/or expense claim under PAM 2006. Firstly, extent of roles of the Consulting Quantity Surveyor are identified in every stage of loss and/or expense claim process. The new claim framework of loss and/or expense is formulated, namely notification, substantiation, assessment, certification and settlement. The extent of roles of the Consulting Quantity Surveyor is identified in every stage of claim except for notification, because his roles are not required in such stage. Among the stages of claim, the weightage of roles played by the Consulting Quantity Surveyor in claim assessment is the heaviest because the outcome of claim is produced in such stage. Throughout the claim process, there are several challenges limited the roles of the Consulting Quantity Surveyor in assessing the loss and/or expense claim. The challenges include the lack of standardisation in describing the conditions, absence of clear guidelines on ascertainment for the amount of claim, lack of supporting evidences and denial of Contract Administrator’s decision. In order to overcome the challenges faced by the Consulting Quantity Surveyor, strategies are reviewed and recommended to improve the roles of the Consulting Quantity Surveyor during loss and/or expense claim, namely, Consulting Quantity Surveyor’s professionalism and proper documentation. In term of level of control, it depends on the Consulting Quantity Surveyor whether to carry out his roles and possess qualities in relation to his profession; whereas, proper documentation is slightly beyond the control of the Consulting Quantity Surveyor because the quality of documentation lies with the Contractor. In this study, a total of nine Consulting Quantity Surveyors as the respondents shared their experience and views during the interview. Upon data collection, coding process is used to analyse the data. The data analysis will be presented by charts and matrices. Then, discussion is made to compare the current findings with researchers’ findings. To conclude, with the latest findings, three objectives of the study are achieved and the extent of roles of the Consulting Quantity Surveyor is ascertained and discussed in detail.
