Abstract

A construction projects always involved in a payment dispute regardless the amount of dispute is huge or small. Payment disputes has been trouble the construction industry for few decades which led to million of Ringgit losses for the industry. Although there are always a preparation before the start of the project but seen like payment disputes would still happen due to several factors. Therefore, the right of parties during payment dispute is important to know in order to minimize the losses as payment disputes is unavoidable. This research is hoping to provide a better understanding for payment disputes from the rise of the problem until the method to resolve in order to minimize the impact toward the project and construction parties. This study will start of with the reason of payment disputes in order to allow the industry to has a better look on how the problem arise. Furthermore, the research would also cover the consequences of payment dispute. This would allow the reader to understand the impact of payment disputes therefore be prepare for the possible outcome from payment dispute. Lastly, the research will be on the standpoint of contractor and covered the right of contractor when facing the payment dispute. This could help the contractor to identify the most effective method on resolving a payment disputes despite solving such disputes would required a lot of resources including time and cost.
